Merchant responsibilities

No substitute for merchant size guidance

The app is a sizing aid. It should be used together with the merchant's own product-specific size guide, especially for wide bands, unusual fits, regional sizing differences, or made-to-order products.

Availability and changes

The operator may maintain, secure, update, suspend, or discontinue features where reasonably necessary. Internet access, Shopify, themes, browsers, devices, merchant catalog data, and other third-party systems are outside the operator's control. The operator does not promise uninterrupted or error-free availability.

Liability

The operator is liable without limitation for intent and gross negligence; for culpable injury to life, body, or health; under an expressly assumed guarantee; and where liability is mandatory by applicable law.

For slight negligence, the operator is liable only for breach of a material contractual duty whose fulfilment is necessary for proper performance and on which the merchant may regularly rely. In that case, liability is limited to the damage typical for the contract and reasonably foreseeable when the service was obtained.

In all other cases, liability for slight negligence is excluded to the extent permitted by law. These limitations also apply to the operator's legal representatives, employees, and agents.

When allocating responsibility, inaccurate merchant data, shopper measurement or calibration errors, browser/display settings, failure to follow visible instructions, and merchant fulfilment or refund decisions are considered to the extent permitted by law.

Third-party claims

To the extent permitted by law, the merchant will indemnify the operator against third-party claims and reasonable defence costs resulting from the merchant's unlawful deployment, inaccurate product information, removal or contradiction of mandatory notices, or breach of these terms. This does not apply to the extent the operator caused the claim.

Governing law and venue

German law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If the merchant is a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the operator's registered office is the exclusive venue, subject to mandatory law.

Operational safeguards

The app may label matches as exact, nearest listed, requiring review, or unavailable. A nearest or review result is never an automatic fit decision. The merchant must stop using the app for affected products if test results, catalog changes, or customer feedback indicate incorrect mappings.
